PREMIERE Center for Cosmetic Surgery
Premiere Center for Cosmetic Surgery (the “Company”), will conduct the Promotion substantially as described in these rules, and by participating, each participant agrees as follows:

If a makeover candidate is disqualified for any reason, the Company reserves the right to determine an alternate makeover candidate or not to award that makeover candidate’s prize, in their sole discretion.
Eligibility and Limitations:
Participants and winner(s) must be U.S. residents at least 21-years old as determined by the Company and reside in the greater Miami, Florida area. . Only one (1) prize per household for the Promotion. Only one (1) prize per household from the Company within any sixty (60) day period. Employees of the Company, the Promotion’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.
Other Requirements:
Each chosen makeover candidate must be pre-approved for the surgical procedure(s) by PREMIERE Center for Cosmetic Surgery at its sole discretion. The standard protocols which need to be completed are as follows:
1. In person office consultation and evaluation with PREMIERE Center for Cosmetic Surgery where they will determine whether chosen candidate(s) is an appropriate candidate for the plastic surgery procedure. Here candidates will be advised of the possible risks & complications of surgery as well as sign necessary consent forms, etc.
2. Each candidate will be provided with the American Society of Plastic Surgeons (ASPS) website and phone # in order for them to do further research and gather more information.
3. Pre-operative testing, medical evaluation, and surgical clearance must be obtained by a qualified physician and is the financial responsibility of the chosen makeover candidate.
4. Makeover candidates who undergo breast augmentation must buy manufacturer’s extended warranty should one be available.
All pro-operative clearance, pre-operative and/or post-operative medications prescribed, x-ray fees or laboratory testing fees are the sole responsibility of the approved makeover candidate. All transportation to and from surgical procedures, immediate surgical after-care, and all procedure follow-up is the responsibility of each approved candidate. If for any reason PREMIERE Center for Cosmetic Surgery does not feel one of the chosen candidates should have a surgical procedure or if the chosen candidate does not feel that they are comfortable undergoing the procedure for any reason. The candidate is not entitled to any monetary compensation. An alternate will be chosen.
The winner can refuse to receive the procedure for any reason. PREMIERE Center for Cosmetic Surgery, its staff or physicians can refuse to perform the procedure at any time if they do not believe the winner is a suitable candidate for surgery.
The selected winner is solely responsible for any and all taxes.
PREMIERE Center for Cosmetic Surgery, its staff or physicians are not in any way financially responsible if the winner refuses to perform the procedure for any reason.
Surgery must be completed no later than 6 months from the date awarded. Prizes are not transferable, redeemable for cash or exchanged for any other prize unless otherwise specifically expressed elsewhere in these rules.
If a makeover candidate cannot be contacted or fails to follow through with makeover procedures he/she will have been deemed to have forfeited the prize and will be disqualified.
Prize(s).
The prize(s) consist of:
1. One specific cosmetic surgical makeover procedure. If for any reason the selected winner is unable to undergo the procedure or the providing physician or any of Premiere Center for Cosmetic Surgery’s staff determines that the winner is not an ideal surgical candidate, the winner will be disqualified from receiving the surgical prize package. If a winner is disqualified or elects to decline the surgical prize, an alternate winner may be selected, in the Company’s sole discretion.
Makeover procedures are performed by PREMIERE Center for Cosmetic Surgery. PREMIERE Center for Cosmetic Surgery will have the final determination on all procedures performed and, at its discretion, may choose to alter or change any procedure. Any such alteration to or change in procedure is subject to approval by the makeover candidate.
Makeover procedures include fees and costs charged for operating room, anesthesia services, consultation fees, follow up fees, cost of saline implants (should winner want silicone implants, they will be offered at a reasonable price which winner will have to pay, in advance of the procedure) (if applicable) excluding Extended Warrantee, and surgical fees associated with accepting each prize procedure. All pre-operative or post-operative medications prescribed, x-ray fees or laboratory testing fees are the sole responsibility of each makeover candidate.
Prize provided by PREMIERE Center for Cosmetic Surgery. PREMEIRE Center for Cosmetic Surgery will have the final determination on the surgical procedure performed.
Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Promotions and waive any claims to royalty, right, or remuneration for such use. By participating in the Promotion, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes. PREMIERE Center for Cosmetic Surgery also is entitled to this information and may chose to use the winners name, photographs, etc. in promotion, on website, etc.
Release. By participating in the Promotion, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Promotion’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which are not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Conduct and Decisions. By participating in the Promotion, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Promotion, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Promotion and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Promotion is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Promotion, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS PROMOTION, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
